Earthly Hands Article XIV · architectural study

Visual experiment · unfinished architecture

The old room remains.

A treaty promise stands. Later governments build machinery around determining who may pass through it.

This is not a complete legal history. It is a sectional study in how the ground changes without erasing the original room.

Article XIV · treaty structure

1830 · treaty chamber

Promise before credential.

The original text establishes a path for remaining in Mississippi, land, residence, grant, and retained Choctaw privilege. It does not contain the later descendant-identity tribunal.

Treaty of Dancing Rabbit Creek · Article XIV

Remain. Signify. Reside. Receive the grant. Do not lose the privilege of a Choctaw citizen.

The later machine will ask different questions. This room stays visible so those later questions do not become the treaty itself.

origin node · treaty promise

1898 · administrative addition

Identity becomes a jurisdiction.

The Commission first articulates a descendant-proof theory; Congress then authorizes it to determine the identity of Choctaw Indians claiming Article XIV rights.

Commission interpretation → Curtis Act §21

The question shifts from what the treaty promises to who this applicant is in relation to it.

Interpretation and statute stay separate. The January 1898 Commission theory is not silently rewritten as treaty text.

new room · identity determination

1900 · gate added

Identification is no longer the end state.

A duly identified Mississippi Choctaw may settle in the Choctaw-Chickasaw country and, upon proof of bona fide settlement, move toward enrollment and allotment.

Identification → settlement → proof → enrollment

A legal identity determination becomes a door into another sequence.

This is one of the moments when an older treaty relation becomes operationalized as a later administrative credential.

gate state · not final state

1901 · proposed wing

Designed. Not opened.

The negotiated agreement developed a more elaborate Mississippi-Choctaw architecture, but the source-controlled implementation path stops at the congressional ratification gate.

unbuilt legal architecture

A doorway drawn into a wall that never became governing law.

The proposed structure matters because it shows what federal and tribal negotiators were trying to build. It does not govern MCR 879 merely because it existed on paper.

1902 · evidentiary architecture

Credential does not become origin.

Final §41 makes full-blood status and descent from an Article XIV patentee express evidentiary lanes while keeping identification, settlement, proof, enrollment, and approval distinct.

Rule of evidence · later machinery

Patent / scrip can carry evidence of an earlier treaty state. They are not the source of the treaty right.

Later Interior construction is especially important here: documentary residue may function as proof without becoming the origin node.

evidence carrier · not origin node

A family claim enters federal machinery

The family claimed Choctaw identity. Federal actors tested that claim through Mississippi-Choctaw and Article XIV machinery.

The file then shows Commission transmittal, Indian Affairs review and recommendation, and Interior review and affirmance. We know that review happened. What remains open is the contemporaneous rule, instruction, or administrative authority that made that merits review proper.

Two case chambers · keep apart

The Article XIV Robert Bell body can be made to do different administrative work.

MCR 879

Family Robert body

Commission decision · 15 Apr. 1902 · pre-final-§41

Federal reviewers compared the family Robert Bell body against the Article XIV Robert Bell body carried through government records and adjudicative material. In MCR 879, that comparison was used in an administrative separation bearing on the family's claim to Choctaw identity and recognition in the Nation.

government characterization

The patented Article XIV Robert is treated as a different man from the family Robert Bell described by the applicants.

Wash / Jane / Sallie body

Other-Robert chamber

Commission decision · 27 Sep. 1904 · post-final-§41

The Commission carries the Article XIV Robert Bell body into the Wash / Jane / Sallie proceeding and uses it in the opposite administrative direction: an identity attachment.

government characterization

The Commission makes an affirmative identity join between the family line before it and the Article XIV Robert Bell body.

The machine changes. The source distinctions remain.

Treaty promise. Commission theory. Statutory jurisdiction. Evidentiary rule. Case decision. Family testimony. Government characterization. Workshop inference.

They may touch. They do not become one thing because the interface places them near one another.
